It's in federal court, the TCPA has recently been held to only apply in state court actions. This fucked over Waid, who has been slowly exhausting jurisdictional arguments and lost his ability to file a TCPA.
This case is in state court, which is part of what makes me think this case is frivilous, I'm not sure how they expect the state to extend its jurisdiction to some of these people (Just kidding, they know it can't)

Especially to hot wheels who does not even live in America. You are already pushing it with people not living in the same state but the moment you start crossing international borders you definitely need to file in Federal Court. All Hot Wheels has to coherently do is file a motion to dismiss for lack of personal jurisdiction. He can probably pay some Texas lawyer 1400 bucks to do it. About the price of having to buy plane tickets to Texas himself.

As an American citizen who resides abroad, Fredrick is in a really good position to defeat jurisdictional arguments from federal court. Diversity Jurisdiction for federal court only applies to citizens of other nations and citizens of other US states. He's a US citizen so diversity jurisdiction fails there, and he's not a resident of any other US state since he lives in the fucking Phillipines, so federal courts will just shrug their shoulders and be like "whelp, good luck suing him somewhere else".

He should hire a TCPA specialist, I know at least one, his name is Jayshawn Lemonhead and he could tack a win on this real quick. I bet he'd take it on contingency.

It would actually be worth a try. Even Lemonhead could win this and get a TCPA award of fees. He's so brilliant he can even win cases that are completely legitimate.

That's all very true except I'm sure he gets SSI and iirc you have to be present in the USA to keep getting the government checks. Think about it, the government isn't going to give out free money to every exceptional individual in the world (not yet anyway), you have to be a citizen and prove you meet the conditions for getting it. He's stupid to think he can do this without an attorney because if he plays fast and loose with the Social Security program and they find out they tend to stop sending checks and make you prove you're entitled to actually get the free money. Sometimes they even make you pay it back if they find you lied about meeting all the requirements.

Social Security Disability is different and in most cases you can live abroad and still get benefits but SSD is based on your earnings and I doubt Frederick's ever had enough earnings in his lifetime to accumulate a decent SSD award.

I'm sorry, it's hard coming up with words to respond to that. So, either they taught him it was okay to break the law, or they failed to teach him that he shouldn't break the law. I mean, I suppose that would be negligence in the vaguest possible use of the term, but I highly doubt that counts as legally negligent.
